Losing a loved one can do so much more than devastate you and your family emotionally. It can devastate you financially, too. If you lose a loved one in an accident, the party that caused the accident may be liable for your related damages. In other words, you could be entitled to recover monetary compensation for losses like the loss of your loved one’s wages, your loss of his or her companionship, his or her funeral expenses and in some cases, even punitive damages through a wrongful death claim.

When you are facing a wrongful death claim, you need an advocate. Work with an experienced Grand Junction wrongful death lawyer to develop a solid claim and pursue the compensation you deserve for your damages.

The insurance companies do not have your best interests in mind when determining damages you are owed for the negligence of another. The insurance companies will immediately attempt to settle the claims for the lowest dollar amount possible. Often, this tactic works and the injured person is left in a devastating financial situation.

Do not let this happen to you, your family and loved ones.

Who Can Recover Wrongful Death Damages in Colorado?

In Colorado, the following parties can file a wrongful death claim:

  • The victim’s spouse;
  • The victim’s surviving children;
  • If the victim did not have a spouse or children at the time of his or her death or if the victim was a minor, his or her parents may file a wrongful death claim; and
  • A representative of the victim’s estate. When a representative of a victim’s estate files a claim for damages the estate suffered, it is known as a survival action.

Within the first year following the victim’s death, only his or her spouse may file a claim with a Grand Junction wrongful death lawyer. An adult child or the victim’s parents may only file a wrongful death claim after one year has elapsed. Other parties, like the victim’s siblings, cannot pursue wrongful death compensation.

Certain compensation is awarded to the victim’s loved ones. Other compensation is awarded to the victim’s estate. The victim’s spouse, children and in certain cases, parents may pursue compensation for the following damages:

  • The victim’s financial contributions to his or her household. They can be compensated for the victim’s projected lifetime earnings if he or she had not died prematurely;
  • The victim’s other familial support, like his or her healthcare benefits; and
  • The loved ones’ own losses, like the loss of the victim’s emotional support, his or her guidance, and his or her love.

A representative of the victim’s estate can pursue compensation for the following:

  • Funeral and burial expenses; and
  • Medical expenses related to the injury the victim suffered before dying.
