The Basics of a Personal Injury Case

When one person’s negligence leads to the harm of another, the injured party has a cause of action to bring forth a civil claim to recover monetary damages. In order for a claim to be successful, though, the claimant must be able to prove the four following elements:

  • Duty of care. A claimant must be able to prove that the at-fault party owed them a duty of care. Often, this is implied.

  • Breach of duty of care. This element involves proving negligence, or the failure to act in the same way that a person of ordinary prudence would. Negligence can mean anything from driving while impaired to failing to remedy a known hazard on a property to manufacturing a dangerous product and more.

  • Causation. The claimant must be able to prove that their injuries would not have been incurred but for the defendant’s negligence.

  • Damages. Finally, the fourth element to establish is damages. Types of damages that are recoverable in a personal injury claim include both economic and noneconomic losses such as medical expenses, lost wages, and pain and suffering.

Important Steps to Take Now

If you’ve been injured in Aspen, there are a few things that you should do immediately:

  1. Seek medical care;

  2. Gather as much evidence as you can initially; and

  3. Hire a personal injury lawyer.

For most personal injury claims in Colorado (with the exception of car accident cases) the statute of limitations is two years from the date of injury, so you only have a limited amount of time to act.
