The Basics of a Personal Injury Case

When one person’s negligence leads to the harm of another, the injured party has a cause of action to bring forth a civil claim to recover monetary damages. In order for a claim to be successful, though, the claimant must be able to prove the four following elements:

  • Duty of care. A claimant must be able to prove that the at-fault party owed them a duty of care. Often, this is implied.

  • Breach of duty of care. This element involves proving negligence, or the failure to act in the same way that a person of ordinary prudence would. Negligence can mean anything from driving while impaired to failing to remedy a known hazard on a property to manufacturing a dangerous product and more.

  • Causation. The claimant must be able to prove that their injuries would not have been incurred but for the defendant’s negligence.

  • Damages. Finally, the fourth element to establish is damages. Types of damages that are recoverable in a personal injury claim include both economic and noneconomic losses such as medical expenses, lost wages, and pain and suffering.
