Delta continues to grow by leaps and bounds, with close to 10,000 people now claiming to be residents. With population booming, more accidents are likely to happen, especially on our roads. Delta residents deserve experienced legal representation when an accident sends them to the doctor.
At Cimarron Ridge Legal Group, our Delta personal injury lawyers have helped people injured in a variety of accidents. No matter how minor your injury, please contact us to review your legal rights.
What Is Personal Injury Law?
Personal injury covers accidents that result in bodily injuries. Our clients have suffered terrible injuries that can require expensive medical care to treat, including:
- Burns
- Abrasions or cuts
- Nerve damage
- Disfigurement
- Fractures
- Back injuries
- Head injuries
- Spinal cord damage
The law of negligence requires that people exercise due care whenever they are around people who could be injured. Unfortunately, far too many people are careless, and their actions end up hurting innocent people. A victim can sue for compensation to cover things like medical care, lost wages, property damage, and pain and suffering.
We Represent Victims of Car Accidents
Anyone can be injured in a parking lot, sidewalk, or on the open road. Hundreds of car accidents happen every year in Delta, and they leave people in need of immediate medical attention.
In any car accident case, our lawyers work to show that the other driver was at fault for the crash. Fault means that they are legally responsible for the accident and for the financial losses our clients consequently suffer.
There are many examples of negligent conduct, including:
- Illegal turns
- Passing on double lines
- Tailgating
- Speeding
- Failure to yield
- Driving on the sidewalk
- Distracted driving
- Impaired driving
- Driving while fatigued
Colorado recognizes that both motorists could be to blame partially for a crash. However, Colorado Revised Statutes § 13-21-111 will bar a lawsuit if our client’s negligence was equal to or greater than the person we are suing. In practice, this means our client can be up to 49% to blame—but not 50% or greater. We work diligently to find evidence of fault and to minimize any errors you might have made in the seconds leading up to the wreck.
Car accidents have a unique wrinkle because multiple insurance policies might be in play. We have made claims with a driver’s liability coverage, uninsured motorist insurance, underinsured motorist coverage, and medical payments policies. Let us untangle how these policies interact with each other.
Wrongful Death
Some accidents are so horrifying that our loved ones die in them. For example, Colorado saw 596 fatal car accidents in 2019. These accidents completely change our clients’ lives.
Fortunately, a person’s personal injury lawsuit does not die with them. Instead, it lives on in a wrongful death lawsuit which can be brought by certain family members. Colorado identifies a right to bring this suit based on a person’s relationship to the deceased:
- In the first year, only the spouse can file. If there is no spouse, then the children or grandchildren of the deceased can file. A designated beneficiary can also file.
- In the second year, the spouse, children, and designated beneficiary can file.
- Parents can only file this lawsuit in the second year if there is no surviving spouse or descendants.
A wrongful death lawsuit provides compensation to the family in the form of money damages. Our clients have sometimes qualified for damages for a variety of losses, such as loss of earnings and benefits, loss of services provided by the deceased, and the cost of medical care and funeral services. A client might also receive damages for grief and pain, as well as other non-economic losses.
Slip & Fall Accidents
Property owners owe a duty to their visitors to keep their property reasonably safe. This duty often requires that they fix hazards they know about or, at a minimum, warn the public of any hazard that cannot be fixed promptly. So if a store wants to mop its floors, it should warn customers so that they can protect themselves.
Our clients have slipped in public businesses, on private residences, and in governmental buildings. The hazards they confront are many:
- Wet floors
- Freshly waxed floors
- Spilled liquids
- Debris
- Loose tiles
- Worn carpets
- Defective staircases
- Poor lighting
Each of these hazards can cause a person to slip and fall, injuring themselves in the process. A critical component of any wrongful death case is to fully document the hazard, because the property owner might quickly fix it after your fall.
